1.1.

All Membership applications are subject to verification by ExclusivelyLuxe.com.

1.2.

You are obliged to provide correct details when you apply for ExclusivelyLuxe.com Membership and your failure to do so may invalidate your Membership and any subsequent transaction. Your responsibility to provide accurate information is a continuing obligation and you must notify ExclusivelyLuxe.com in the event that any information provided by you changes.

1.3.

Your Membership is personal to you. You are responsible for ensuring that no one (other than whom you choose to allow access) uses your Membership.

1.4.

Access to and use of the Members section of the ExclusivelyLuxe.com website ("Site") is through a combination of user name and password and is reserved exclusively for Members. You are solely responsible for maintaining the confidentiality of your user name and password and you agree to notify ExclusivelyLuxe.com immediately if you believe that there has been any breach of security (e.g. the unauthorized use of your name and password).

2.1.

Membership fees are communicated upon application. The first Membership fee is due at the sign-up, or after the completion of the Trial-Period. ExclusivelyLuxe.com reserves the right to increase subscription rates at any time. Changes to standard subscription rates will be posted on the ExclusivelyLuxe.com website. The new subscription rates will apply to existing accounts at the time of their next renewal. Customers subscribing at specially discounted promotional rates may be subject to varying rate increases, none of which shall exceed the standard posted subscription rate.

2.2.

ExclusivelyLuxe.com reserves the absolute right to cancel or suspend your Membership (at its sole discretion) for any reason whatsoever.

2.3.

Your Membership fees is non refundable. However, ExclusivelyLuxe.com may at its sole discretion elect to refund your Membership fee in whole or in part depending on the circumstances relating to the cancellation of any Membership.

2.4.

Membership Subscription fees are charged monthly by PayPal’s Automated Subscription Service. Cancelation of our service is the responsibility of the client and MUST be done directly through PayPal.

2.5.

The right to use the Service is personal to you and any other person you have given your account number and PIN to, or any other persons calling in with the necessary information to access and utilize  services. You are responsible for all use of your Account by any person and for ensuring that all use of your Account complies fully with the provisions of this Agreement.

2.6.

You are responsible for protecting the confidentiality of your password, PIN, account number, and any other phone numbers listed on your account. Errors made in the process of entering information into a customers' account is their responsibility, and should take proper action to correct them.

2.7.

You acknowledge and agree that you will not receive a bill in the mail for your subscription.

3.1.

A billing cycle begins on the date of the month that the contract is entered into either online, over the phone, or in a written contract. The billing cycle ends one day before the calendar day of the following month or when the current block of minutes expires i.e. if you start your account on June 6, the last day of your billing cycle ends on July 5.

3.2.

If your credit card is declined and the payment not successful, the account will be disabled until such a time when the account is brought up to the proper monetary amounts. The day that ExclusivelyLuxe.com receives your payment, becomes your new effective billing cycle start date.

3.3.

When a customer first signs up to ExclusivelyLuxe.com, they are given access to a risk-free seven (7) day trial of our concierge service.
VERY IMPORTANT:  Your trial period begins immediately when you sign up.  For example, if you sign up at 4pm on 1/1/09 that is considered day one; 1/7/09 is considered day seven; and on 1/8/09 at 12am or anytime thereafter, ExclusivelyLuxe.com has the right to charge your card, via PayPal, for the full monthly subscription amount.  The time zone that ExclusivelyLuxe.com and its clients abides by is the EST (Eastern Standard Time Zone) There are other plans that can be customized by ExclusivelyLuxe.com personnel.

4.1.

We are available to take requests 24/7/365 by telephone, e-mail or through the Site's contact form. Please take note that your individual staff members WILL NOT be available 24/7 (they've got to sleep too).  For times when they are not available, you will still be able to utilize our services by simply making contact via the email address and telephone number listed and they will respond at their next available moment.

4.2.

ExclusivelyLuxe.com will provide both the services described on the Site (from time to time) and concierge services at your request - that is you may request ExclusivelyLuxe.com to provide or arrange any lawful, proper and moral personal service in relation to any personal needs or desires (including, without limitation, provision of information, access to events, activities and venues, and personal goods and services) (the “Services”).

4.3.

ExclusivelyLuxe.com reserves the right to withdraw any of these Services and/or to refuse to supply the Services requested.

4.4.

If ExclusivelyLuxe.com is unable to deal with any request, it will inform you as soon as reasonably practicable.

4.5.

Suppliers are responsible for providing you with the services, products and benefits you select. ExclusivelyLuxe.com will communicate with Suppliers on your behalf unless it is more appropriate for you to contact the Supplier directly.

4.6.

Suppliers may impose their own terms and conditions and you are required to comply with these.

4.7.

When ordering a product or service or accessing a benefit, you may be required to provide your Payment Card details. If you request and authorize ExclusivelyLuxe.com to use your Payment Card in order to pay a Supplier for products or services, you acknowledge and agree that ExclusivelyLuxe.com shall have no liability in respect of or be responsible in any way whatsoever in respect of the use of your Payment Card provided that ExclusivelyLuxe.com acts in accordance with the instructions issued by you in relation thereto.

4.8.

You undertake that all details you provide to us for the purpose of booking, ordering or purchasing products or services are correct, that the Payment Card you are using is your own and that there are sufficient funds to cover the cost of the product or the service.

4.9.

From time to time the procurement or provision of certain services, products or benefits may incur a ExclusivelyLuxe.com handling charge (of which you will be notified) - in these cases you hereby authorize ExclusivelyLuxe.com to debit your Payment Card with any such handling charges.

4.10.

Unless otherwise agreed by the Supplier, you shall not be entitled to cancel any services requested where, on your instructions, performance has already begun.

5.1.

You may only make requests by telephone, SMS(Text Message), e-mail or through the Site’s Contact Form.

5.2.

Members must provide their membership ID number and 4-digit security code upon request of ALL services. This step protects our members' membership and associated benefits.

5.3.

Text messaging & Email - User will not hold ExclusivelyLuxe.com responsible for any lost text messages, emails, or any other correspondence generated by ExclusivelyLuxe.com or User. User understands that electronic data (Text Messages & Email), when sent over the public domain, is no longer in control of ExclusivelyLuxe.com, and we cannot guarantee that the data will successfully reach the intended user or destination, and that any resulting claims for loss of time, money, material or otherwise cannot be claimed against ExclusivelyLuxe.com. If ExclusivelyLuxe.com sends a response to a query whether text messaged or called in to a User and the User dos not receive the message, the User may call the ExclusivelyLuxe.com phone line and either ask for the answer to be verbalized or resent via text message. The User will not be charged for that call as long as the only purpose for the call is to retrieve an answer never received.

5.4.

User understands that all minute charges will be billed in full minute increments. The time kept of the call is synchronized with the International Atomic Clock. Any portion of a minute is considered a full minute by the ExclusivelyLuxe.com billing system. Billing will start from the time that the ExclusivelyLuxe.com agent picks up the phone, receives an email or text message and identifies the caller as an ExclusivelyLuxe.com User to the time that the answer is given and/or text messaged, emailed, verbalized or communicated to the User in any way. User understands and agrees that in certain instances such as when queries are text messaged in or the User requests the ExclusivelyLuxe.com agent to perform a search for information while the User is not on the phone that billing will continue during the search process until the information is communicated to the User. In some instances an answer or solution to a query will not be found and the User will still be billed for time that the agent spent looking at websites. Requests for retrieval of past queries will be considered as research.

5.5.

Billing questions and account changes will not be charged to the customers' plan.

5.6.

Concierge Recommendations and Information: The concierges' comments and recommendations presented on the Site are based on research and opinions collected by the concierges, and are subject to change at any time.  In addition, all responses will be provided based upon REASONABLE research and efforts on behalf of our operators.   We do not recommend utilizing our services for financial, legal, tax or other sensitive matters.

5.7.

Telephone calls to ExclusivelyLuxe.com may be monitored or recorded for training and quality control purposes.

6.1.

Any services including travel tickets and package holidays purchased through ExclusivelyLuxe.com will be subject to the terms and conditions of the travel or holiday operator and the Supplier. Please note that ExclusivelyLuxe.com is NOT an authorized travel agent or tour operator and only acts as an introductory agent on behalf of the Supplier. All rights and remedies you have are against the relevant Supplier.

7.1.

ExclusivelyLuxe.com is engaged in the business of obtaining “best tickets” for all sold out events either directly itself or through one of its ticket agent Partners. Please note that you are purchasing tickets above face value, which includes service charge(s) reflecting our costs and efforts in obtaining your premium seats.

7.2.

All sales are final, no refunds or cancellations are issued after you have purchased your tickets.

7.3.

In the events of show cancellations directly by the artist/promoter, only the return of the face value of the tickets can be guaranteed. Shipping fees are non-refundable. Refunds will be paid by the promoter or Ticketing Company, not ExclusivelyLuxe.com. In such an event, we are not to be held responsible, but will work hard on your behalf to get the best possible result.

8.1.

Either party shall have the right to terminate this Agreement at any time by providing notice of termination to the other. In the event of termination of this Agreement by either party, you shall have no claims against ExclusivelyLuxe.com or its affiliates. Termination of this Agreement automatically terminates your license to use the Service and any content or other material contained therein.

8.2.

You may terminate this Agreement anytime after the date of activation of your Account. Subscription cancelation is the sole responsibility of you, the client. Should you wish to cancel your account for any reason, login to your PayPal account to cancel the subscription service. We are not responsible for unwanted charges to your account due to failure to cancel the service.

8.3.

Cancellations should not be considered final until you have received a Cancellation Confirmation e-mail from ExclusivelyLuxe.com.

9.1.

As a user of the Services including Forums, Chats or Postings on this Site, you agree to use the Services and the Site only for lawful purposes. Use of the Services or the Site for transmission, distribution, retrieval or storage of any information, data, or other material in violation of any applicable law or regulation is prohibited. You also agree not to use the Services or the Site to:

ExclusivelyLuxe.com warrants to you that ExclusivelyLuxe.com shall use its reasonable endeavors to provide the Services with reasonable care and skill and, as far as reasonably possible, in accordance with your request and instructions from time to time. You are deemed to be responsible for, and shall use your own skill and judgment as to, the quality, value and suitability of such information and suggestions in relation to deciding whether to enter into any contract with any third party for the supply of services or sale of goods.

ExclusivelyLuxe.com will not be responsible for products and services offered by ExclusivelyLuxe.com as agents for the Suppliers or for any aspect of the relationship between you and any particular Supplier. ExclusivelyLuxe.com will however do everything it reasonably can to assist you in any dealings you have with the Supplier.

10.3.

You agree that any contract entered into by you with any of the Suppliers is an independent contract. ExclusivelyLuxe.com hereby disclaims any and all liability for any act or omission of any Supplier or any loss incurred by you as a result of any act or omission of a Supplier whether or not arranged through the ExclusivelyLuxe.com call centre.

10.4.

ExclusivelyLuxe.com accepts no liability for any losses or claims arising from any inability to access the Site or any failure to complete a transaction.

10.5.

Save in respect of death and personal injury caused by the negligence of ExclusivelyLuxe.com or as expressly provided for in these Terms of Use, ExclusivelyLuxe.com shall not be liable for any loss, cost, expense or damage of any nature whatever (whether direct or indirect) resulting from the provision of the Services or your reliance upon the information and suggestions provided by ExclusivelyLuxe.com hereunder and the resulting supply of goods and services to you by any third party.

ExclusivelyLuxe.com aims to ensure that viruses (or other programs having adverse effects) do not reside on the Site, but ExclusivelyLuxe.com accepts no responsibility in relation to this.

This section applies only to the extent permitted by law.
